Welcome to Foody. Food Delivery Services, an online platform that facilitates food and grocery transactions between customers, sellers, and delivery riders. By accessing or using Foody., you agree to comply with these Terms and Conditions of Use. Please read them carefully before using the app.

1. Definitions

• “Foody.” refers to the mobile application and its associated services.
• “User” refers to any individual or entity using the app, including Sellers, Delivery Riders, and Customers.
• “Seller” refers to a user who lists and sells products through the app.
• “Delivery Rider” refers to a user who accepts delivery requests and delivers orders.
• “Customer” refers to a user who purchases products via the app.
• “Content” refers to any data, text, images, or other material shared or uploaded by users.

2. Account Registration and Security

• Users must provide accurate and complete information during registration.
• Users are responsible for maintaining the confidentiality of their account credentials.
• Foody. reserves the right to suspend or terminate accounts suspected of fraudulent activity.

3. User Responsibilities

3.1 Sellers

• Must ensure all product listings are accurate and comply with applicable laws.
• Are responsible for fulfilling orders promptly.
• Must not sell prohibited or illegal items.

3.2 Delivery Riders

• Must accept and complete deliveries in a timely and professional manner.
• Are responsible for the proper handling of food and groceries.
• Must comply with all traffic and safety regulations.

3.3 Customers

• Must provide accurate delivery information.
• Are responsible for payment of orders placed.
• Must not abuse or misuse the app’s services.

4. Payments and Transactions

• Foody. facilitates transactions between users but does not process payments directly.
• Users must use approved payment methods for purchases and deliveries.
• Foody. is not responsible for disputes between users regarding payments.

5. Cancellations and Refunds

• Customers have the right to cancel their orders while it is on “Pending” status.
• Customers may cancel their orders while the order status is ‘Pending’ (i.e., before the seller confirms and begins preparation). If a cancellation occurs at this stage, customers are eligible for a full refund (if already paid). Once the order is accepted or in progress, cancellations and refunds are subject to the seller’s policy.
• Customers must follow the cancellation and refund policy provided by sellers.
• Foody. is not liable for disputes regarding refunds or cancellations.

6. Privacy and Data Protection

• Foody. collects and processes personal data in accordance with its Privacy Policy.
• Users consent to the collection and processing of their personal information.
• Foody. implements security measures to protect user data but does not guarantee absolute security.

7. Prohibited Activities

Users must not:

• Use the app for fraudulent or illegal activities.
• Post misleading or harmful content.
• Attempt to hack, exploit, or disrupt Foody. or its services.

8. Intellectual Property

Users must not:

• All content and trademarks associated with Foody. remain the property of the app’s developers.
• Users may not copy, modify, or distribute app-related content without permission.

9. Dispute Resolution

• Disputes between users should be resolved amicably.
• Foody. is not liable for conflicts between users but may mediate at its discretion.
• Legal disputes shall be governed by the laws of Republic of the Philippines.

10. Termination and Suspension

• Foody. reserves the right to suspend or terminate accounts that violate these Terms.
• Sellers or Delivery Riders may terminate their account at any time by contacting support.
• Customers may terminate their account at any time by deleting their account.
